在2020年通过Abortion Legislation Act 2020，彻底将堕胎非罪化之前，新西兰的堕胎法律体系大部分基于1977年通过的一系列法律，包括 Contraception, Sterilisation, and Abortion Act 1977 以及 Crimes Amendment Act 1977 。简单来说，法律允许20星期以前的堕胎，但需要满足 Secti on 1 87A(1) Crimes Act 1961的条件之一，包括由乱伦，犯罪所造成的怀孕，婴儿发育不良等等。
其中最著名的一条条件是Section 187A(1)(a):
“that the continuance of the pregnancy would result in serious danger (not being danger normally attendant upon childbirth) to the life, or to the physical or mental health, of the woman or girl;”
